Oh the drama. The news media cannot get enough of telling half truths and lies. And neither can politicians. I collected some articles about this fiasco perpetrated by a Judge who also sat on the FISA court once.
Guess when? That's right. During the FISA hearing(s) for the fake Russians collusion hoax that permeated the first term of President Trump and the Democrats still will not let go of even after being fully debunked.
Below are a few articles about the drama, but do read on to read the actual law itself so you read for yourself that the Judge really has no legal standing. The law does not need proof of gang membership. And in any event, all those people are here illegally and subject to removal under Title 8, U.S.C.
"As Congress explicitly recognized in the recent Administrative Procedure Act, some statutes "preclude judicial review." Act of June 11, 1946,§ 10, 60 Stat. 237, 243. Barring questions of interpretation and constitutionality, Page 335 U. S. 164 the Alien Enemy Act of 1798 is such a statute. Its terms, purpose, and construction leave no doubt. The language employed by the Fifth Congress could hardly be made clearer, or be rendered doubtful, by the incomplete and not always dependable accounts we have of debates in the early years of Congress. "
Ludecke v. Watkins, 335 U.S. 160 (1948)
"A federal judge sharply questioned the Trump administration Monday about its decision to rush three planes carrying Venezuelan nationals out of U.S. airspace under President Donald Trump’s unprecedented invocation of wartime deportation powers against a criminal gang."
The judge who tried to stop the deportation planes is not happy with the Trump administration
- Trump criticized U.S. District Judge James Boasberg for blocking the deportation of over 250 gang members, stating he should be impeached for obstructing his immigration policies.
- The deportees included 21 MS-13 members and over 230 Tren de Aragua members, as reported by White House Press Secretary Karoline Leavitt.
- Republican Texas Representative Brandon Gill announced plans to file articles of impeachment against Boasberg, citing his history of opposing Trump's immigration policies.
- The White House contends that Judge Boasberg did not have a lawful basis for his order, as the deportation flights were already in the air.

At this point, it’s probably necessary to remove any security clearances Boasberg has and investigate in-depth any financial ties he has to the foreign terrorist organizations at issue in this case.

"A legal firm with deep ties to George and Alexander Soros’s network of left-wing nonprofits and non-governmental organizations (NGOs), is partially behind a lawsuit attempting to block President Donald Trump from deporting illegal alien gang members from the United States under the Alien Enemies Act, Breitbart News has learned."
Watch the video in the article here. The lawsuit filed to stop these flights was on bewhalf of only five people. Those five people may not have even been deported yet.
"A House GOP lawmaker has filed impeachment articles against the federal judge who ordered the Trump administration to stop deportation flights being conducted under the Alien Enemies Act."
SCOOP: Impeachment articles hit judge who ordered Trump to stop Tren de Aragua deportation flights
- A coalition of 26 state attorneys general filed an amicus brief to support the Trump administration's deportation of TdA gang members, arguing it protects public safety and national security.
- U.S. District Judge James Boasberg issued an injunction halting the deportations of 261 gang members, prompting an immediate appeal from the Trump administration.
- Virginia Attorney General Jason Miyares emphasized the government's duty to protect citizens and stated that the president's actions are constitutionally protected.
- Supreme Court Chief Justice John Roberts criticized Trump's comments on the judiciary, affirming that impeachment is not an appropriate response to judicial decisions.

Enough with the drama. Here's the facts, Jack. Read carefully and see what the law requires and where it is satisfied:
"Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event, all natives, citizens, denizens, or subjects of the hostile nation or government, being of the age of fourteen years and upward, who shall be within the United States and not actually naturalized, shall be liable to be apprehended, restrained, secured, and removed as alien enemies. The President is authorized in any such event, by his proclamation thereof, or other public act, to direct the conduct to be observed on the part of the United States, toward the aliens who become so liable; the manner and degree of the restraint to which they shall be subject and in what cases, and upon what security their residence shall be permitted, and to provide for the removal of those who, not being permitted to reside within the United States, refuse or neglect to depart therefrom; and to establish any other regulations which are found necessary in the premises and for the public safety."

50 U.S. Code § 21 - Restraint, regulation, and removal
"By the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby proclaim:
America's sovereignty is under attack. Our southern border is overrun by cartels, criminal gangs, known terrorists, human traffickers, smugglers, unvetted military-age males from foreign adversaries, and illicit narcotics that harm Americans, including America.
This invasion has caused widespread chaos and suffering in our country over the last 4 years."
