Trump's Birthright Order

As we know, President Trump is wanting to get rid of DACA and birthright citizenship for children born of illegal immigrants, or 'anchor babies'.  He may have a fight as his order seems to look to the 14th amendment.

To me though, the line in the fourteenth amendment where it says, " . . . and subject to the jurisdiction thereof, . . ." pretty much shows that it is not an automatic thing, but there are conditions.  So, break it down.  What jurisdiction is an illegal immigrant subject to in this country and/or state?  Breaking immigration laws.  Pretty cut and dried to me.  That's why Democrats leave out the "illegal" part out; just calling them immigrants.

Yes, instead of just using an Executive Order to reverse Obama's Executive Order created DACA program that the Dems act as if it was voted on and passed into law; Trump is going after the whole pretense itself.  On the bright side, a court has declared DACA un-constitutional.  However, the challenge to his EO is happening, something which I expected.

 

"A federal appeals court ruled Friday that the controversial Deferred Action for Childhood Arrivals program, known as DACA, was illegal but stopped short of allowing a nationwide injunction issued by a federal judge in Texas to go into effect. The three-judge panel of the Fifth Circuit ruling on the case restricted the scope of the injunction to Texas to allow further appeals.

"DACA is, in my opinion, the toughest part of the illegal immigration catastrophe facing the United States to solve. DACA enrollees arrived in the United States as very young children when their parents or guardians illegally immigrated. They are culturally American and frequently can't speak the language of their home country and have no family or social ties to it. There are an estimated 580,000 DACA enrollees."

"On Tuesday, attorneys general from 22 different states sued President Donald Trump to block an executive order that refuses to recognize birthright citizenship of U.S.-born children of illegal aliens in the United States.  New Jersey Attorney General Matthew J. Platkin, who led the legal effort, said that Trump’s effort to limit birthright citizenship is “extraordinary and extreme.”"

  • Arizona Attorney General Kris Mayes is suing over President Trump's executive order to ban birthright citizenship, which was signed on his first day in office.
  • The order states that citizenship documents will not be issued if at least one parent is not legally in the U.S. Through citizenship or permanent residency.
  • Eighteen states and two cities have filed a lawsuit to block the order, claiming it is unconstitutional and violates the 14th Amendment.
  • Attorney General Matt Platkin stated that the President cannot write the 14th Amendment out of existence, emphasizing the importance of citizenship for children born in the U.S.
