It Was A Win For A While

In the continuing saga over the deportation drama, the Supreme Court has issued a couple of orders, now a few weeks apart.

"The Supreme Court on Monday allowed President Donald Trump to enforce the Alien Enemies Act for now, handing the White House a significant victory that will let immigration officials rely on a sweeping wartime authority to rapidly deport alleged gang members.

"The unsigned decision in the case, one of the most closely watched emergency appeals pending at the Supreme Court, lets Trump invoke the 1798 law to speed removals while litigation over the act’s use plays out in lower courts. The court stressed that going forward, people who are deported should receive notice they are subject to the act and an opportunity to have their removal reviewed by the federal court where they are being detained."

Then last Saturday in a rush this came out of SCOTUS:

"The Supreme Court early Saturday morning paused the deportation of immigrants potentially subject to the Alien Enemies Act, freezing action in a fast-developing case involving a group of immigrants in Texas who say the Trump administration was working to remove them. 

"Alito, in a scathing dissent Saturday night expanding on the one-line dissent he issued with the initial order, criticized the Court, saying his colleagues acted “hastily and prematurely” to grant “unprecedented” emergency relief to a putative class of Venezuelans.

""Literally in the middle of the night, the court is­sued unprecedented and legally questionable relief without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order,” Alito wrote in a dissent that was joined by Justice Clarence Thomas."
